This Thom Educational Solutions Privacy Policy is published by Thom Educational Solutions, LLC. and all of its subsidiaries and affiliates shall be collectively referred to in this document as “TES” or “we”.  We maintain websites at https://thomedsol.com, https://givemycard.com, https://takemybizcard.com,  and https://mypaparazzicard.com  (these sites (and all content available through either domain name) are collectively referred to herein as the “TES Website” or our “site”); and we license the TES Digital Business Cards (TES Biz Cards), TES Technical Services (TES Services) and TES Cloud-based Products (“TES Products). This notice explains our online information collection and use practices and the choices that users of the TES Website, TES Biz Cards, TES Services and TES Products (“you”) can make about the way we use and share such information.  It is important you read and understand this policy so you can understand how we may use your Personal Information.

TES is cognizant of the U.S. – E.U. and U.S. – Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal data from European Union member countries and Switzerland. TES privacy practices align with the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement.

1        Information We Collect.

1.1     Corporate Customers.  We license our TES Services and TES Products to professional organizations such as law firms (“Corporate Customers”) that use our Digital Business Cards to assist them in networking with clients and other business contacts.  Corporate Customers generally direct us to collect information concerning that Corporate Customer’s individual personnel that are enrolled in the Digital Biz Card program (“Corporate Members”).  You should understand that our collection of Corporate Member information is under Corporate Customer direction rather than via direct relationships with individual Corporate Members.  

1.2     Individual Customers.  We also license our Digital Business Card Products to individual professionals such as attorneys (“Individual Customers”).  In this case, our collection of information is via our direct relationships with such Individual Customers.

1.3     Personal Information.  As directed by our Corporate Customers or Individual Customers (together, “Customers”), the types of data for individuals that we collect may include name, address, title, e-mail address, telephone number, mobile number, professional affiliations, job position, social media account url’s, website url’s, and other unique identifiers such as username and password (“Personal Information”).   Other Personal Information that we may collect in the course of providing service to our Customers could include mobile device data such as location, device type, operating system and telecommunications carrier.

1.4     Anonymous Information.  In addition, we collect anonymous usage data concerning our users (“Anonymous Information”) such as frequency of use, browser types, IP address and other network information.

2        How We Use and Disclose Information.

2.1     Use of Your Personal Information.  Our primary uses of your Personal Information are to:

  • Fulfill Customer orders for our services
  • Provide TES Product and TES Services to our Customers and Customer Members
  • Respond to service and support requests
  • Administer your account
  • Personalize your experience on the TES Website
  • Send requested product or service information to you
  • Send marketing communications to you

2.2     Communications.  We may send newsletters and marketing communications to users that have a registered TES portal account.  If you do not wish to receive such communications, you may opt out by following the unsubscribe instructions provided with the communications or on your client portal account page.  We may also send you necessary service-related announcements (e.g., for temporary service suspension or account renewal).  You may not opt-out of such service communications so long as your TES portal account is active.

2.3     Disclosure of Personal Information.  We share your Personal Information only for the purpose(s) you provided it, with your consent, or as otherwise described in this Section 2.

2.4     Third Party Service Providers.  To assist us in providing our services, we may rely on the services of third party contractors and service providers (“Service Providers”), such as email service or Customer support providers.  We transfer Personal Information to Service Providers only as needed to enable us to provide our services.   We also ensure that such Service Providers are bound by this Privacy Policy with respect to your Personal Information.

2.5     Testimonials.   We may post user testimonials on the TES Website.  We will obtain your consent via email prior to posting a testimonial that contains your Personal Information.  To remove a testimonial, contact us at support@thomedsol.com.

2.6     Legal Disclosures.  We may use and disclose your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our legal rights.   Whenever possible, we will provide notice to you of such disclosures.

2.7     Mergers and Acquisitions.  In the event of a TES business transition, such as a merger, acquisition, or sale of assets, we may transfer your Personal Information as part of such transaction.  We will notify you via email at least 30 days prior to any such transfer.

3        Control and Storage of Personal Information.

3.1     Requests to Modify or Delete.   You may access, and modify or delete some of your Personal Information via your TES client portal account page or submitting a support ticket.  We respond to all Customer requests to modify or delete Personal Information within 3 business days.  . 

3.2     Data Retention.  We retain Personal Information on behalf of our Customers for as long as needed to provide our services to such Customers.  We further retain this Personal Information as necessary to comply with our legal obligations, resolve disputes, and to enforce our rights.

4        Security.  We have appropriate physical, electronic, and managerial procedures in place to safeguard Personal Information, and help prevent unauthorized access and maintain data security.  Unfortunately, no data transmission over the Internet or data storage solution can ever be completely secure. As a result, although we take steps to protect your information, we cannot ensure or warrant the security of any information you transmit to or receive from us or that we store on our or our Service Providers’ systems.

5         Cookies.   To enhance your online experience with us, many of our web pages use “cookies.”  Cookies are text files placed on your hard disk by our web server to store your preferences.  Cookies, by themselves, do not tell us your e-mail address or other Personal Information unless you choose to provide this information.  If you do choose to provide Personal Information, however, this information may be linked to the data stored in the cookie.  We use cookies as a convenience feature to save you time, and to improve the content and offerings on our site.  For example, we may use cookies to personalize your experience at our web pages or recall your specific information on subsequent visits (e.g. to recognize you by name when you return to our site).  We also may use cookies to offer you products, programs or services.  You can opt to have your browser reject cookies, however, if you do, you may disable the convenience features of our site.  This Privacy Policy does not cover how third-party companies use their cookies.

6         Clear GIFs.  We may use “pixel tags,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixel Tags”) in connection with some TES Website pages and HTML-formatted email messages to, among other things, compile aggregate statistics about website usage and response rates.  A Pixel Tag is a small electronic image that is ordinarily not visible to website visitors, and may be associated with cookies on visitors’ hard drives.  Pixel Tags allow us to count users that have visited certain pages of the TES Website, deliver customized services, and help determine the effectiveness of promotional or advertising campaigns.  When used in HTML-formatted email messages, Pixel Tags can tell the sender whether and when the email has been opened.

7         Log Files. As is true of most web sites, we and our Service Providers automatically gather certain information for storage in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.  This information does not identify individual users.  We may use this information to administer the site, track users’ site movements and gather demographic information.

8         Social Media Features. Our site may include social media features, such as the Facebook “Like” button.  These features may collect information such as your IP address, and may set a cookie to enable the features to function properly.   Please be aware that your use of these features is not governed by this Privacy Policy, but instead is governed by the privacy policy of the company providing the features.

9         Public Forums. Our site may offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be publicly read, collected, and used.  To request removal of information you post on our blog or community forum, contact us at support@thomedsol.com.  In some cases, we may not be able to remove your information, in which case we will let you know if we are unable to do so and why.

10      Links to Other Websites.  Our site may contain links to other sites whose practices may be different than ours.  You should check the other sites’ privacy notices since we have no control over information that they collect.

11      Notification of Privacy Policy changes. We may update this Privacy Policy to reflect changes to our information collection or retention practices. If we make any material changes, we may notify our Customer users via email or via a notice on our site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
